Residents in Land O' Lakes, Lutz and Odessa can no longer release sky lanterns at weddings, graduations or backyard celebrations. Pasco County commissioners voted Tuesday, July 14, to ban the devices countywide, citing fire and pollution risks.

Ordinance 26-29, signed by Board Chairman Jack Mariano and attested by Clerk and Comptroller Nikki Alvarez-Sowles, prohibits the intentional release of sky lanterns or any similar device "at any time," including on holidays recognized under Florida law.

The ban covers any balloon-type device that uses fire underneath to become airborne. That includes Kongming lanterns, fire balloons, sky candles and wish lanterns.

County cites fire risk and pollution as reasons for the ban

The county's Business Impact Estimate, published June 9, stated the ordinance's purpose plainly: minimizing "the potential for fires that affect public health and safety." The board's own whereas clauses in the ordinance added pollution as a second concern.

No new fees or charges come with the ordinance. But violators face fines under the county's uniform fine schedule and could be held responsible for costs incurred in extinguishing any fire their lantern starts.

Only scientific and government releases are exempt

One exception exists. Governmental or scientific entities may release sky lanterns for scientific, meteorological or governmental purposes, but only with written authorization from the Pasco County fire marshal.

Residents planning late-summer or fall backyard events should note: There is no holiday exception. The ban applies on the Fourth of July, New Year's Eve and every other date on the calendar.

Ordinance takes effect once filed with the state

The ordinance becomes law upon filing with the Florida Department of State. The clerk's office must file a certified copy within 10 days of the July 14 adoption, putting the filing deadline at Friday, July 24. The ordinance document is marked "sent to state," though no confirmation from the Department of State has been published.

The county's own impact estimate acknowledged it does not know how many businesses in unincorporated Pasco sell sky lanterns. No new compliance costs are imposed on retailers.
