Hillsborough County is considering a request to rezone approximately 10.15 acres near U.S. 41 and Duque Road in Lutz from ASC-1 to Planned Development.
The application, RZ-PD 26-1221, was heard by the Zoning Hearing Master on Oct. 19 and remains pending a recommendation, according to the county case record. The record lists the application for the Board of County Commissioners' Dec. 8 land use meeting. No final decision has been recorded.
Applicant Barry Newberger seeks rezoning of three parcels listed at the southeast and southwest corners of the intersection. The property is in the county's rural service area and carries comprehensive plan designations R-1, R-2 and NMU-4.
The rezoning request is a proposal, not permission to begin construction. The county case page links supporting materials, and residents can use the application number to request the complete file from Development Services.
The case is currently classified as a consent agenda item. Under county participation rules, testimony is not provided on consent agenda items. Qualifying as a party of record does not, by itself, allow someone to speak on a consent item.
For cases placed on the regular agenda, qualifying parties of record may address evidence already in the hearing record. Parties of record include people who presented testimony or documentary evidence at the Zoning Hearing Master hearing, received the required mailed notice, or submitted documentary evidence within the county's prescribed period. Additional restrictions apply to people whose standing comes solely from mailed notice.
Requests to introduce additional evidence must generally be filed with the Clerk of the Board of County Commissioners within 10 calendar days after the hearing officer's recommendation is filed. The board must determine that the request meets county criteria; filing a request does not guarantee acceptance.
Residents should confirm the filing date, applicable deadline and final agenda before attempting to participate. For case information, contact Development Services at 813-272-5600. Additional-evidence requests can be submitted to [email protected].
