Decisions on wetland encroachments, a proposed school and a community residential home are pending for property owners in unincorporated Land O' Lakes, Odessa and Lutz after the Hillsborough County Land Use Hearing Officer heard nine applications on Monday, Aug. 10.
Rulings are due by Aug. 31.
The cases, listed in the hearing agenda, include two wetland-setback variances, three fence or wall variances, an accessory structure request, a lot-development variance, a drive-through distance-separation variance, a special-use school application and a special-use community residential home. Seven additional cases were continued to the Sept. 14 hearing.
Darrell Curts asked to encroach into the wetland setback at 13914 Levinson Rd., a 1.76-acre parcel zoned RSC-4. Shane Garvey made a similar request for a 0.44-acre lot at 1005 Willis Rd. in the Rural service area.
Casey J. and Abigail M. Kotchman sought a fence and wall variance at 18623 Dorman Rd., a 10.21-acre Agricultural Residential parcel. Jay and Angela Loyd requested an accessory structure variance at 3822 Ralston Rd., a one-acre lot zoned AS-1.
Todd Pressman of Pressman & Assoc., Inc. appeared on two separate matters: a special-use application for a school and a lot-development variance at 6801 N. Orient Rd., a 10.67-acre site, and a drive-through distance-separation variance for a 0.64-acre parcel on E. Dr. Martin Luther King Jr. Blvd. between Peek St. and Laura St. The school application had been continued from the July 13 hearing. No details on the proposed school's operator, grade levels or enrollment capacity appear in the public record.
Tampa Civil Design sought a special use for a community residential home at 10515 Memorial Hwy., a 4.95-acre parcel zoned Agricultural Residential. That application was also continued from the July 13 hearing before being heard Aug. 10.
Other cases heard included Joshua Trent Bush's fence variance at 2804 Kimmi Tree Ln., Luisa I. Alonso's lot-development variance at 8403 Seven Coves Ct. and Jeffrey Zock's fence variance at 4907 Troydale Rd.
The seven continuances to Sept. 14 include Pablo and Ever M. Lam, Bo's Electric & Gas/Deivid Marquez, Nicole MacInnes-Barbas Cremer PLLC, William Pino Rodriguez, Steve Kocher, Carmen Rosario Veras and Sean Jones, who is seeking a wetland-setback variance at 601 Chastain Rd. on 1.3 acres.
For unincorporated communities like Land O' Lakes, Odessa and Lutz, the Hearing Officer is the primary land-use decision-maker. Variance decisions may be appealed to the Land Use Appeals Board within 30 calendar days of the Aug. 31 decision date, putting the appeal deadline around Sept. 30.
